Is a Durham Uber claim worth it if my old back injury got worse?

North Carolina law does not let an insurer escape payment just because your back was not perfect before the crash. The rule is simple: if the collision made an old condition worse, the at-fault party is responsible for the aggravation, not just brand-new injuries.

That matters a lot for rideshare passengers.

If you were in an Uber during back-to-school traffic near a Durham school zone, the claim may involve the Uber driver's insurance, the other driver's insurance, and Uber's liability coverage. As a passenger, you are usually in a stronger position on fault than either driver. North Carolina's harsh contributory negligence rule often blocks drivers who were even slightly at fault, but it usually does not hit an innocent passenger the same way.

So is it worth the hassle? Often yes, if the crash turned a manageable condition into worse pain, more treatment, or lost income. A pre-existing injury usually lowers the fight's simplicity, not necessarily its value. The real question is whether the wreck caused a measurable worsening.
